These terms apply when you pay for a license through Likeness. You accept them, with the Terms of Service and the Privacy Policy, before checkout, and the version you accept is recorded with your checkout and frozen onto the license when it is granted.

1. What you are buying

You are buying a license from a creator, on the terms in the quote you were shown: the permitted uses, the platforms, the territories, whether commercial use is allowed, the term and the price. The license lets you use the protected copy that Likeness delivers to you only for those uses, in those territories, for that term. Anything not listed is not licensed. A license is personal to the buying organisation, cannot be transferred or sublicensed unless the quote says so, and does not allow training an AI model on the photo.

The license is a contract between you and the creator. Likeness is not a party to it and does not give you any right beyond it, except that Likeness issues and records the license, delivers your copy, and decides refunds, suspensions and terminations as set out below.

2. The license is frozen at grant

When your payment is confirmed the license is granted and its terms are frozen: the quote, the price, the uses, the creator's self-attestation status as shown to you, and the version of these terms you accepted. Later changes to the creator's rules, to Likeness policies or to these terms apply to future licenses only. A license ends at the end of its term, or earlier if it is refunded, suspended or terminated under section 6.

3. Self-attested creators: no verification, no warranty of identity

Self-attested by the creator. Likeness has not verified their identity.

Creators state for themselves that they are the person shown and that they hold the rights. Likeness has not checked either statement. Likeness gives no warranty or assurance that a creator is who they say they are, that the photo shows them, or that they hold the rights they offer. You should decide whether to rely on a license in light of that. A watermark on your copy shows that the file came through Likeness; it is not proof of identity or of ownership.

4. How you may use the copy

Use the copy only as the license allows, keep the watermark intact, and keep the license record. You must not remove or obscure the watermark, use the copy or anything made from it to deceive voters or influence an election, to commit fraud or to impersonate anyone, use the copy to imply the person endorses something other than the licensed use, depict them in a way that is sexually explicit, defamatory, deceptive or unlawful, or use the photo to create a deceptive impression of what they said or did. Output you make while the license is in force: if the license allows generating or altering a face or voice, you must label the result as AI-generated or altered wherever the law requires and never present it as genuine. Partners and platforms may check files for Likeness watermarks; a check result is a signal, not a legal finding.

5. Price, payment and refunds

The price is shown in the quote and paid through Stripe's hosted checkout; Likeness does not see your card number. Taxes, if any, are shown at checkout.

You can be refunded when: the copy could not be delivered or the license had to be put on hold; the creator's offer is withdrawn or removed after a report in a way that makes the license unusable; or Likeness staff decide a refund is fair after a report or dispute. Refunds are decided by Likeness staff and paid through Stripe to the original payment method. Otherwise, payments are final. This does not affect any right you have by law.

6. Suspension, termination and takedown

Likeness staff may suspend or terminate a license, and recommend a refund, after a report, a dispute, a breach of these terms, a finding that the creator's attestation was untrue, or a legal request. When a license is terminated for reasons not caused by you, your remedy is a full or partial refund as decided under section 5. You must stop using the copy once a license is terminated, except where the law says otherwise. What happens to output you already made while the license was in force: After a license ends you may not newly publish or distribute output made under it, except where the law says otherwise. Report a problem using the Takedown and Report Policy.

7. Disclaimers and liability

THE COPY AND THE SERVICE ARE PROVIDED "AS IS". The disclaimers, the limitation of liability (including its single liability cap), the indemnity, the force majeure and the sanctions and export terms in the Terms of Service apply to this license; these terms add no separate cap. You will indemnify Likeness and the creator against claims arising from your use outside the license.

8. Changes and law

A new version of these terms must be accepted before your next checkout; licenses already granted keep the version they were granted under. [GOVERNING LAW, VENUE AND DISPUTE RESOLUTION — TBD, same as the Terms of Service]
